Virtual Personal Training Waiver, Health Declaration and Liability Release

This Waiver, Health Declaration and Liability Release (“Agreement”) applies to all virtual personal training sessions (“Sessions”) delivered by The Health and Fitness PT and booked via a Fittle email address or platform.

By booking and participating in a Session, you confirm that you have read, understood and agreed to the terms below.

Provider: The Health and Fitness PT
Facilitator: Fittle Fitness Ltd (“Fittle”)

1. Acknowledgment of Risk
   I understand that participation in personal training, strength training and exercise programmes involves inherent risks including but not limited to muscle soreness, strains, sprains, falls, aggravation of existing injuries, cardiovascular complications, serious injury and, in rare cases, death. I voluntarily choose to participate in these Sessions with full knowledge and acceptance of these risks.

2. Health Declaration
   I confirm that I am physically fit and sufficiently healthy to participate in exercise. I have disclosed any relevant medical conditions, injuries, surgeries, medications or other health considerations to The Health and Fitness PT prior to commencing Sessions. If I have any concerns about my health, I have consulted or will consult a qualified medical professional before participating.

I understand that it is my responsibility to stop exercising immediately if I feel unwell, dizzy, faint or experience pain.

3. Virtual Training Acknowledgment
   I understand that Sessions are delivered remotely via video call and that the instructor cannot physically assist or correct me. I am responsible for ensuring that my environment is safe and suitable for exercise, including adequate space, stable flooring and appropriate footwear.

I accept full responsibility for my positioning, technique and surroundings during the Session.

4. Equipment Responsibility
   I acknowledge that I am solely responsible for the safe assembly, setup, inspection and use of any equipment used during Sessions, including but not limited to the Fittle Box and associated accessories.

I confirm that I will follow all safety instructions provided and will not use damaged or improperly assembled equipment.

5. Release of Liability
   To the fullest extent permitted by law, I release and discharge The Health and Fitness PT and Fittle Fitness Ltd, including their directors, employees, contractors and affiliates, from any liability, claims, demands or causes of action arising from or connected with my participation in the Sessions, except in cases of negligence that cannot legally be excluded.

I understand that The Health and Fitness PT is an independent service provider and that Fittle acts solely as a booking facilitator and is not responsible for the delivery of the training services. Any insurance coverage relating to the Sessions is held by The Health and Fitness PT.

Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence where such liability cannot legally be excluded under UK law.

6. Insurance
   I understand that The Health and Fitness PT maintains appropriate professional indemnity and public liability insurance. Fittle does not provide insurance coverage for these Sessions.

7. Privacy
   Sessions will not be recorded unless explicitly agreed in writing. Any personal information shared will be handled in accordance with applicable UK data protection laws.

8. Governing Law
   This Agreement is governed by the laws of England and Wales.

Participant Confirmation

By booking and attending a Session, you confirm that you have read and understood this Agreement and that you voluntarily agree to its terms. You also confirm that you are at least 18 years of age.
